RESEARCH FIELD

  • Among the broad areas of interest, my focus of research involves two: (1) legal studies or jurisprudence in general(법학 일반), with a focus on philosophy of law(법철학); (2) the mutual implications between science-technology and law(과학기술과 법 서로 간의 영향과 함축). As for philosophy of law, I am primarily interested in the “methodological” issues in law and jurisprudence(법철학의 방법론적 쟁점들). To take some topics of interest, I am interested in (i) analytical methodology in jurisprudence(법학의 분석적 방법론), (ii) naturalism or empirical studies as an alternative approach to law(법학의 자연화/과학화), (iii) the status and role of thought experiments and analogies in law or jurisprudence(법학에서의 사고실험과 유추). In addition to the methodological issues, the “normative” issues(자유, 정의, 평등, 책임 등 법철학의 규범적 쟁점들) such as legal equality, justice and responsibility captivate my interest as well.Regarding science and technology law, my interest extends largely in two directions. The first goes from law to science-technology, addressing how to regulate or promote science and technologies using legal or policy means. Intellectual property law(지식재산권법) or bioethics and law(생명윤리법) can best illustrate this line of work. The work in the second direction, which has been less explored but is quite important, deals with the implications from science-technology to law. This line of work may concern the disciplines such as the so-called ‘neurolaw’(신경법학), ‘cognitive studies of law’(인지법학) and ‘evolutionary studies of law.’(진화법학)
